Employment-based visa sponsorship Process:

1. Labor Certification (if applicable): The employer may need to secure labor certification from the Department of Labor (DOL) to confirm that no qualified U.S. workers are available.

2. File Petition (Form I-129): The employer must submit a petition (Form I-129) to USCIS on behalf of the foreign worker.

3. Approval Process: USCIS reviews the petition. Then, the case is forwarded to the National Visa Center (NVC) if approved and the worker is abroad.

4. NVC Processing (for consular cases): The NVC schedules an interview at the U.S. embassy or consulate in the worker’s home country.

5. Adjustment of Status (if applicable): If the worker is already in the U.S., they may apply for a green card after USCIS approves the petition.
